Legal
Terms of use
These terms apply to the Construction Defect Reporter Android app and this website. By installing or using the app, you agree to these terms. If you do not agree, do not use the app.
1. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you control, for your internal business or professional purposes, subject to these terms and the Google Play terms. You may not resell, sublicense, reverse engineer or redistribute the app except where the law permits it.
2. Your records and responsibilities
You are responsible for the accuracy, completeness and lawful use of the project records, photographs and reports you create. You must comply with site safety rules, privacy obligations, confidentiality requirements and applicable law when photographing people, property or sites. Do not use the app to record unlawful, harassing or misleading material.
You are responsible for maintaining backups of records you need to keep. The app stores data on your device; device loss, damage, uninstallation or deletion can remove it. Exports and backups stored outside the app are your responsibility.
3. Report disclaimer
Reports record site observations made by the author at the time of inspection. They are not a certificate of regulatory compliance, a structural assessment or a substitute for professional or legal advice. Rectification and verification remain the responsibility of the parties named in the report.
The app is a documentation tool. It does not make professional judgements, certify compliance, or replace an appropriately qualified inspector, engineer, certifier or legal adviser.
4. Purchases
The optional lifetime unlock is a one-time non-consumable product sold through Google Play. Payment, taxes, refunds and purchase restoration are handled by Google Play under its terms and policies. The app stores only the product identifier, unlock status, source and relevant timestamps; it does not receive or store your card details. Restoring a purchase requires a store connection.
5. Availability and changes
We may update, change or discontinue features. We aim to keep reports and data accessible, but we do not guarantee that every future Android version, device or file format will remain compatible. Back up important records. Features described on this site may change before or after release.
6. Intellectual property
The app, its design, text, graphics and branding are owned by or licensed to us. Your project data, photographs and reports remain yours. You grant us no ownership of your content; we do not receive it through a server.
7. Privacy
The privacy policy explains how the app handles information. It is part of these terms.
8. Liability and consumer rights
To the extent permitted by law, we are not liable for indirect or consequential loss, loss of data, loss of profit, or decisions made from the app's output. You must keep your own backups and independently verify site conditions. Nothing in these terms excludes, restricts or modifies any guarantee, warranty, right or remedy that cannot be excluded or limited under applicable consumer law, including the Australian Consumer Law where it applies.
